New Jersey Statute Annotated 2C:25-19 defines "Domestic Violence". It states that "Domestic Violence" means the occurrence of one or more of the following acts inflicted upon a person protected under the Domestic Violence Act: (1) homocide, (2) assault, (3) terroristic threats, (4) kidnapping, (5) criminal restraint, (6) false imprisonment, (7) sexual assault, (8) criminal sexual assault, (9) lewdness, (10) criminal mischief, (11) burglary, (12) criminal trespass, (13) harassment and (14) stalking. When one or more of these acts is inflicted by an unemancipated minor upon a person protected under the Act, the occurrence shall not constitute "domestic violence." "Victim of domestic violence" means a person protected under the Act and includes any person 18 years of age or older or who is an emancipated minor and who has been subjected to domestic violence by a spouse, former spouse, or any other person, regardless of age, who has been subjected to domestic violence by a person with whom the victim has a child in common or with whom the victim anticipates having a child in common, if one of the parties is pregnant. "Victim of domestic violence" also includes any person who has been subjected to domestic violence by a person with whom the victim has had a dating relationship.
The victim of domestic violence may apply for a temporary restaining order barring the perpetrator of domestic violence from having contact with the victim, the victim's family and other named individuals. The temporary restraining order provides for a hearing on short notice at which a judge is to determine whether the restraining order is to be dismissed or replaced by a permanent restraining order.The temporary restraining order and permanent order may provide other forms of relief such as granting temporary custody of the parties' child or children and requiring the payment of child support and spousal support.The permanent restraining order may also provide for family counseling and anger management counseling.
A FINDING THAT AN ACT OF DOMESTIC VIOLENCE HAS BEEN COMMITTED CAN HAVE VERY SERIOUS CONSEQUENCES. A CAREER AS A POLICEMAN OR MILITARY OFFICER COULD BE BROUGHT TO AN ABRUPT END BECAUSE ONE CONSEQUENCE IS THAT ONE WHO IS FOUND TO HAVE COMMITTED AN ACT OF DOMESTIC VIOLENCE IS STRIPPED OF THE RIGHT TO CARRY A GUN. FOR SOMEONE WHO IS NOT A CITIZEN, DEPORTATION COULD BE THE RESULT.
